A guest at the Econo Lodge in Willoughby Spit in Norfolk, the client suffered an injury to a tendon in his left hand as a result of the negligence of the owner to fix a maintenance issue.
The client placed a pizza box on top of a three foot tall refrigerator in his room. When the client went to remove the box, he severed the tendon of his left middle finger on an exposed metal strip where there should have been a plastic guard.
The injury required five surgeries to repair, including a tendon graft. The graft required a tendon to be removed from the plaintiff's forearm. Some range of motion remained intact; however, the client lost strength in his finger and grip strength of the non-dominant hand.
Our firm argued that the defendant should have been aware of the dangerous condition due to the fact that the cleaning staff duties consisted of cleaning the inside and outside of the refrigerators located in each room to which the owner of the hotel testified as true. The case was tried before a jury who awarded a verdict to the client.
