Our client was injured in a premises liability incident that occurred on February 13, 2005 while shopping at a large store in Albemarle County. Our client was crouched in an aisle of the store examining some products on a bottom shelf when our client was abruptly struck on the head, left shoulder, arm and hand by a falling ladder. The ladder was positioned behind our client, leaning unsecured on the opposite side of the aisle. Our client suffered immediate blurred vision and pain, but no loss of consciousness.
Our client followed up with the family physicians at Forest Lake Family Medicine at which point was referred to Martha Jefferson Hospital for x-rays and examination. No significant findings were noted on the x-rays, but our client continued to suffer significant pain in the neck and severe headaches. Our client was then recommended for an MRI. Our client was diagnosed with cervical stenosis at the C5-C6 level. This condition eventually led to surgical intervention before our client could experience substantial improvement in the condition. Our client initially attempted conservative treatment with a chiropractor but did not see significant improvement. Our client then consulted with a neurosurgeon, Dr. Gregory Helm, affiliated with the University of Virginia who performed a C5-C6 disk fusion.
Our client has a permanent injury with an increased risk for arthritis and degenerative disk disease above and below the surgical site per the surgeon Dr. Gregory Helm. Our client continues to experience a decrease in the loss of range of motion in the neck and experiences intermitted pain from time to time. Our client incurred a total of $65,506.61 in medical expenses.
